Many verbal agreements that sound "no problem" often turn out to be powerless in the face of unexpected situations. When signing a cement spreader leasing contract, the following clauses must be carefully scrutinized word for word:

第一，租赁期限与计费方式。明确是按天、按月还是按工程量（如每平方米单价）计费。如果是按月租赁，每月的具体工作时长是多少？超时如何计费？如果遇到雨天等不可抗力导致停工，租金是否顺延？

First, the lease term and billing method. It should be clarified whether the billing is based on a daily, monthly, or quantity-based (such as unit price per square meter) basis. If the lease is on a monthly basis, what are the specific working hours per month? How is overtime billed? If work is suspended due to force majeure events such as rainy weather, will the rent be postponed accordingly?

第二，设备维修与故障处理。合同中应明确规定，车辆在租赁期间出现自然故障（非人为操作失误），出租方必须在多长时间内（如24小时内）安排维修或调换车辆。维修期间是否扣除租金？这一点对于工期紧张的项目至关重要。

Secondly, equipment maintenance and fault handling. The contract should clearly stipulate that in the event of natural faults (not due to human error) occurring to the vehicle during the lease period, the lessor must arrange for repair or replacement of the vehicle within a certain time frame (such as within 24 hours). Should rent be deducted during the maintenance period? This is crucial for projects with tight schedules.

第三，安全责任划分。明确施工期间的交通安全责任和生产安全责任。通常情况下，出租方负责提供车况良好、手续齐全（行驶证、营运证等）的车辆和具备资质的司机；承租方负责提供安全的施工场地、合理的调度指挥，并协助办理工地通行手续。若因承租方指挥不当造成的事故，责任应由承租方承担。

Thirdly, division of safety responsibilities. Clarify the responsibilities for traffic safety and production safety during the construction period. Generally, the lessor is responsible for providing vehicles in good condition with complete documentation (driving license, operating license, etc.) and qualified drivers; the lessee is responsible for providing a safe construction site, reasonable scheduling and command, and assisting in handling site access procedures. If an accident is caused by improper command from the lessee, the responsibility should be borne by the lessee.
